Cayetano might be appointed as VP by Pres. Duterte in case Robredo is disqualified

An article claimed that in the event Robredo is disqualified because of the SOCE issue, chances are Cayetano might be chosen as VP by Duterte.

For the benefit of the uninitiated, the burning issue now is the non-filing of the SOCE or Statements of Campaign Contributions and Expenditures by the Liberal Party.

Let me quote the position of Dr. Antonio Contreras in light of the late filing of SOCE by Liberal Party.

1. RA 7166 states that non-filing of SOCE by a candidate or party will cause affected winning candidates to forfeit their seats, in addition to being fined.

2. RA 7166 does not authorize COMELEC to extend the deadline of filing of SOCE.

3. Rule 10 issued by COMELEC affirms this by stating the deadline of June 8, 2016 is not extendible, and any submissions beyond that will not be accepted. Hence, this amounts to a de-facto non-filing of SOCE which has the effect of forfeiture of elective posts and fines.

The La Salle professor has been critical of the Liberal Party and VP-elect Robredo due to the allegations of electoral fraud.

In fact, Dr. Contreras was one of the two individuals who have been vocal against electoral fraud committed by the Liberal Party, benefitting VP Robredo and the LP senators.

As the specter of disqualifications against Robredo and her LP party mates, Dr. Contreras couldn’t contain his excitement of a divine vindication.

It looks like a karma moment. There are allegations of widespread and massive cheating committed by LP.
In the light of the fact that the party failed to submit the party’s SOCE as prescribed by law (30 days after the election, which was on June 8, 2016), then are we now seeing the specter of a widespread filing of disqualification cases against the winning party candidates from Vice President down the line to Councilor?

In the event, Robredo is disqualified as VP, President Duterte will have to choose among the senators to be his VP though the law of succession.

If you’d recall, when Arroyo was hoisted into the Presidency via EDSA Dos, she had the privilege of choosing Senator Teofisto Guingona as her VP through the law of succession.

Article VII, Sec. 9 of the 1987 Constitution states:

Section 9. Whenever there is a vacancy in the Office of the Vice-President during the term for which he was elected, the President shall nominate a Vice-President from among the Members of the Senate and the House of Representatives who shall assume office upon confirmation by a majority vote of all the Members of both Houses of the Congress, voting separately.

Since Senator Allan Peter Cayetano is President Duterte’s running mate as VP in the last election, ergo logic dictates the latter will handpick his losing VP candidate to replace Robredo.
